In a dramatic turn of events, the Koforidua High Court has struck out an injunction suit filed by independent candidate, Kwadjo Asante, against the Member of Parliament for Suhum, Frank Asiedu Bekoe.
The suit, which sought to prevent Frank Asiedu Bekoe from being sworn in and holding himself out as the MP for Suhum, was withdrawn by the petitioner after the lawyer for the MP argued that the injunction was moot.
The court’s decision was influenced by the fact that Frank Bekoe had already been sworn in as the validly elected MP for Suhum, and the Electoral Commission (EC) had subsequently gazetted the 2024 Parliamentary results for Suhum.
The lawyer for Frank Asiedu Bekoe, Garry Nimako Marfo, argued that granting the injunction would be an exercise in futility, as the events sought to be prevented had already occurred.
The case has been ongoing, with Kwadjo Asante challenging the legitimacy of Frank Asiedu Bekoe’s election as MP for Suhum.
However, with the withdrawal of the injunction suit, Frank Bekoe will continue to serve as the MP for Suhum until the substantive case is determined.
The next court sitting is scheduled for Monday, March 31, 2025.
Mr Bekoe was present in court, accompanied by the Suhum NPP Constituency Executives.
